"Red Flags Rule"
The Federal Trade Commission issued this notice today, October 22, 2008;
that it would delay implementation of the "Red Flags" rule until May 1,
2009. The rule requires that creditors, (including healthcare providers)
adopt programs to identify and respond to indicators of identity theft.
Promulgated under the FACTA laws, the rule was scheduled for mandantory
compliance to become effective on November 1, 2008. The delay is welcome
and quite timely as most healthcare providers were not aware of the new law
or the consequences of noncompliance. MDIS will continue to develop a
compliance model for dentists, which will be released sometime
before May 1.
